1. Service Description

CustomCardGame.com ("the Service") is an online platform that allows you to design and create custom card games. You upload photos and describe characters, and we generate illustrated card art, stats, abilities, and print-ready card designs. You may also order physical printed card decks for delivery.

2. Account Terms

  • You must sign in using Google OAuth to create an account and use the Service.
  • You are responsible for maintaining the security of your Google account and any activity that occurs under your account.
  • You must be at least 13 years old to use the Service.
  • You must provide accurate information and keep your account information current.
  • One person or entity may not maintain more than one account.

3. Payment Terms

The Service offers the following one-time purchases (not subscriptions):

  • Digital deck generation: $9.99 per deck. This covers the creation of custom card art and digital card designs for your deck. You may preview a limited number of cards before purchasing.
  • Physical print order: $29.99 per deck. This covers the production and shipping of a physical printed card game deck.

All payments are processed securely through Stripe. Prices are in USD and include applicable processing fees. For refund details, see our Refund Policy.

4. User Content

"User Content" includes photos you upload, character names and descriptions, and any other content you provide to the Service.

  • You retain ownership of all User Content you upload to the Service.
  • By uploading User Content, you grant us a limited license to use, process, and store that content solely for the purpose of providing the Service to you (e.g., generating card art from your photos).
  • You represent that you have the right to upload any photos or content you provide, including the consent of any individuals depicted.
  • You are solely responsible for ensuring your User Content does not violate any third-party rights.

5. Intellectual Property

  • Your content: You retain all rights to the photos and content you upload.
  • Generated art: Card art, illustrations, and designs we create for your deck are licensed to you for personal and non-commercial use. You may share your cards, display them, and use your printed decks freely. You may not resell the generated art as standalone artwork or use it in competing products.
  • Service IP: The Service itself, including its design, code, card templates, and rendering system, remains our intellectual property.

6. Acceptable Use

You agree not to use the Service to:

  • Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Upload photos of individuals without their consent.
  • Create content that promotes violence, discrimination, or hatred.
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
  • Use the Service to generate content for illegal purposes.
  • Interfere with or disrupt the Service or its infrastructure.
  • Use automated tools to scrape or access the Service beyond normal use.

We reserve the right to suspend or terminate accounts that violate these terms.

7. Limitation of Liability

To the fullest extent permitted by law:

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not guarantee that the Service will be uninterrupted, error-free, or that generated art will meet specific expectations.
  • Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

8. Physical Print Orders

Physical card decks are printed and fulfilled by The Game Crafter, a third-party print service. Shipping times, print quality standards, and fulfillment are subject to The Game Crafter's terms and capabilities. We act as an intermediary and will work with you to resolve any issues with your physical order, but ultimate fulfillment responsibility lies with the print provider.

9. Termination

  • You may stop using the Service at any time. To delete your account and data, contact us at the email below.
  • We may suspend or terminate your access to the Service at any time for violations of these Terms, with or without notice.
  • Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law.
  • If we terminate your account without cause, we will refund any unused paid services.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
